Terms of Service

These Terms of Service ("Terms") govern your use of the AI phone answering service provided by Frontline Answering ("we," "us," or "our"), operated by Michael Federico out of Wayne, NJ. By using the service, you agree to these Terms.

1. The service

Frontline Answering provides an AI-powered phone answering service for plumbing companies. The service answers incoming calls on a client's behalf, gathers caller and job details, books appointments, sends confirmation texts to callers, and forwards lead information to the client. Specific features may change over time as we maintain and improve the service.

2. Who may use the service

The service is intended for businesses. By signing up as a client, you represent that you are authorized to enter into these Terms on behalf of your business and that you own or control the phone number(s) you ask us to answer.

3. Client responsibilities

4. Not a guarantee of results

We work to answer every call and book qualified jobs, but we do not guarantee any specific number of calls answered, leads generated, appointments booked, or revenue earned. The AI may occasionally misunderstand a caller or be unavailable due to factors outside our control, such as telephone network or third-party outages.

5. Emergency calls

The service is not an emergency service and is not a substitute for 911 or other emergency responders. Callers with a life-safety emergency should hang up and dial 911. The service triages plumbing urgency only and escalates to the client according to the client's instructions.

6. Fees and payment

Fees, billing frequency, and any trial terms are set out in the separate agreement or invoice between you and Frontline Answering. Fees are due as stated there. We may change pricing on reasonable notice for future billing periods.

7. Call recording and data

Use of the service involves recording and processing calls and handling caller contact information, as described in our Privacy Policy. You are responsible for ensuring that answering, recording, and texting on your behalf complies with the laws applicable to your business and its customers.

8. Acceptable use

You agree not to use the service to break the law, harass anyone, send unlawful messages, or misrepresent your business. We may suspend or end the service if it is used in a way that is unlawful, abusive, or harmful to callers or to us.

9. Third-party services

The service relies on third-party providers for telephony, speech processing, scheduling, messaging, and hosting. We are not responsible for the acts, omissions, or outages of those providers, though we will make reasonable efforts to maintain reliable service.

10. Disclaimer of warranties

The service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

11. Limitation of liability

To the fullest extent permitted by law, Frontline Answering will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost business, or missed opportunities, arising from or related to the service. Our total liability for any claim relating to the service will not exceed the amount you paid us for the service in the three months before the claim arose.

12. Indemnification

You agree to indemnify and hold harmless Frontline Answering from claims, damages, and expenses arising out of your use of the service, your handling of leads and customers, or your violation of these Terms or applicable law.

13. Termination

Either party may end the service as described in the separate agreement, or with reasonable notice if no term is stated. On termination, we stop answering your calls and, on request, provide or delete records associated with your account in line with our Privacy Policy.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "last updated" date above. Continued use of the service after a change means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in New Jersey.
